    renting

ok we signed a 1 year lease at this place i am at now me and brit couldnt aford the last mounths rent so we are moving out soon.

they are saying we have to go to court and if we get evicted and they are saying that after that it will be hard to get a new place for 7 years.

then they are saying we had to give them 60 days notice befor moving out.

but they never reminded us or even told us ever about it.

1 lady says it is because of the cops being called on our apartment

then another said it is 100% our responcability.

Nowadays, evicting people is actually a pretty hard task. The process can take over a year for homeowners defaulting on a mortgage. Renters also have some leeway, not sure on those laws but they could easily be looked up. If you do get a court ordered eviction, then it would be something managers could look up during the application process next time you rent. I would probably get squared away with what is owed on rent. You do have to give a notice (usually 60 days) that you will be moving out, in most apartment terms.

It's always best to carefully read the paperwork you sign when initially renting a place, so you will have no surprises when it comes to rental terms.

And thats 60 days in writing also. If you do get an unlawful detainer on your record it will be a bitch to get another place and it does stay on your record for 7 years. It has nothing to do with police either. Genrally speaking most leases let you buy out for the cost of 2 or 3 months rent, and since you signed the lease it is your responsibility to pay. With only 4 months left I would imagine that its going to cost you about the same wether you move out or not. I would try and sit down with your landlords and come to some sort of agreement, otherwise its going to suck.

Just a note, unless they changed the law when your landlord files for eviction you automatically get another 60 days on the premisis.

Whatever the lease says, you do.

The lease is your tell all informational insurance policy for both parties.

There is nothing anyone here can tell you because everyones lease agreements vary.

I would try and set up something with the management co or owner. Get some sort of deal worked out so that the owner gets the right rent ( no extra or bullshit) and you get out of the lease. You can tell them that a judgement won't yield them squat other than legal fees (cost). I'm in the mortgage business, and no one is going to make you pay for that after a good amount of time but it will affect your credit rating. Renting in the future with an unlawful detainer will be tricky, too. I'd go for the win/win.

But does the lease require 60 days notice? And most leases state that they convert to month to month at the end of a 1yr. I'm not piling on, just trying ot make you aware.

You may have had a contractual agreement to let them know 60 days in advance that you will move out, however, according to all the court cases that the apartment complex I used to work for lost regarding that issue you only have to give a 30 day notice in Minnesota. Contract or not.

You can suck up to the landlord, tell your sob story, try and work out a deal, and get on a payment plan.
