In this case, there is no jury or trial, but a pronoucement of presumed guilt by the judge who was not even in the courtroom when said evidence was presented. I think the quote was, "I'm sure it's not you though. It's everyone else that's lying". (Flawed as the pronoucement may be, it would be correct if stated as, "...everyone else who's lying" as people are not referred to as "that" in proper speech.
