    Elk River Police

    Had a run in with the Elk River Police yesterday.

    Apparently on my way home from up north, I pissed off someone when I cut
    in front of them to exit into Elk River. (Is the only "aggressive" action I remember taking). Someone who knew someone apparently. When I pulled onto 10, a squad was waiting specifically for me.

    He pulled me over (not speeding at all, in fact was doing about 50mph getting passed by others).

    I handed him my license and ins. card right away figuring I was the
    goat of a crack-down of some kind.

    He asked "Do you know why I pulled you over?" I'm thinking how cliche, but
    responded truthfully "I have no idea."

    He goes on to tell me "We had a report of you driving irradically, in fact
    dangerously coming down 169. Diving in and out of traffic, and travelling
    at an extremely high rate of speed."

    My response actually drew a chuckle from him:
    "Uh... ok. 169 was a parking lot on the way down...Not sure how I
    would have been speeding, much less diving in and out of traffic."

    He waited for a fellow officer to come along, (while running my info
    throught the 'puter). They discussed the situation for awhile, then
    the younger officer (the 2nd to arrive) approached the car.

    He explained that it was my word versus someone who PHONED IN
    A COMPLAINT. He then looked at my son in the passenger seat...
    "Is this your boy?" "Yes" "How old is he?" "4"
    That being the case, he gave me back my license
    and insurance card, and asked me to just be cautious when traffic
    is as heavy as it was today, and slow down.

    I think they were fishing for a reason to give me a ticket
    when asking about my son. He rides up front in the
    passenger seat in the Mach, because he is too big to fit in a
    child seat (has been since he was just over 3), and the booster
    seats don't fit between the bolsters in the mach seats.

    All I could think of was THANK GOD I had removed the loud a$$
    pro-chamber last week, or this was a ticket for sure.

    As it was, they gave the car a good listening too as I pulled
    away before they jumped on the road behind me and
    followed me to the edge of town. Where they
    promptly U-turned to go after someone else.

    In summary, they were doing there job, and I can respect that.

    BUT...
    If all it takes is a phone call to get someone pulled over, that
    is harrassment at its finest (in my opinion).

    I give them credit for making the right decision and letting me
    go (since they really had no reason to pull me over to begin with).

    Not pissed, just adding further information to our discussions
    we have on this board about police activity around
    the TC area.

      And what LAW were they enforcing.

      Not ensuing an argument, just curious.

      Is this utilizing the "suspicion of..." scenario?

        Just minding my business, putzing through my neighborhood and heading to night class around 1730 one evening and apparantly I was "doing 60mph" - according to some yahoo with seemingly calibrated eyesight - in a 35mph zone.... Absolutely ridiculous and there was no way to prove a thing yet the deputy calls my house after receiving the complaint over the phone and proceeds to ask me all about my day.... After a while I demanded to know what the hell this was about to which he replied that I was seen "doing 60mph" on a road near my house. Then he says I can be given a ticket with just that one person's complaint. I said well how about I file a complaint promptly regarding the person levying charges against me to which he said he would not tell me who it was that filed the complaint. B as in b, S as in s...... Now that was the last straw.... I just told him to either give me the damn ticket and we will see how it goes in court or get off my case. He told me to just slow down and this and that, blah blah... What a patronizing little fuck! Without a clue as to what really occured I have this prick fathering me about my driving!

        This crap must stop. It is harrassment and it is a degredation of our liberties.

        If you are able, save them a place inside of you and save one backward glance when you are leaving for the places they can no longer go. Be not ashamed to say you loved them, though you may or may not have always. Take what they have left and what they have taught you with their dying and keep it with your own. And in that time when men decide and feel safe to call the war insane, take one moment to embrace those gentle heroes you left behind.

          Well, you know he's not going to give you the name so you can retaliate against them. As far as asking you, there are Miranda rights. In addition to that, he wanted you to confess because he had no proof. As far as issuing you a ticket based on someone else's observations? I believe that would be like a citizens arrest where they then have to testify against you.

            For those wondering...

            I sent an email outlining this situation to Russ Wicklund at the Minnesota State Patrol to find out what exactly the law says about this type of scenario, and how traffic officers are supposed to respond to it.

            I will post his reponse when/if I receive it.

                      Oh, all it takes is a phone call. When I delivered pizzas in Forest Lake, they got at least one call a week about my truck, even though I never once broke a law. All I ever did was take side streets through town to avoid lights/stop signs. I think the only reason people ever thought I was going to fast is because it wasn't exactly quiet. And if I ever did drive eraticly, which I didn't, they never had any proof...not so much as a rubber patch, from my truck. All the marks they said were mine were WAY to narrow (295 width tire) to be my truck, and the local boys agreed.

                        I think it is kinda standard in this type of incident, that no citation is handed out (unless you are foolish enough to spill your guts).

                        My biggest concern, is when there are false reports (like I ran into), now my name is known as is my car, so if I am ever stopped for some other infraction, they find my name ON RECORD. Whereas up until now, I haven't even spoken (directly) with a police officer for 8, 9, or maybe even 10 years.

                        THAT is what irks me.

                        A "repeat offender" is far more likely to get tagged than a first timer.

                          HAHAHA I had the exact same thing happen to me!!! Except this cop says I passed him and his family returning from the cabin and that he was gonna send me a ticket. Never happened

                            from the law enforcement side, what would have happened if we (cops) didnt investigate the complaint and u were in fact screwing around, got in an accident and killed someone? also, if he were to have given u a ticket (highly unlikely IMO) he would have had to got in touch with the complainant and got a statement from them and the complainant would be the one testifying against you, not the cop...same as if u see someone u think is driving drunk, i would hope u would call law enforcement and report it...we try to get our own reasonable suspicion for any traffic stop called in, especially DUI stops so then it isnt your word against the defendants word...makes ur life easier as u probably wont have to go into court to testify, but if u see someone u suspect of drunk driving i hope u call it in...now thats not to say some "driving complaints" arent from some people just being jerks trying to get someone in trouble who didnt really do anything wrong, but how does law enforcement know the difference without checking all complaints out???

                            one thing ive learned (among hundreds) is that the general public (some on this board from what i have read) should go out and ride along with the cops and see things from the other side of the rearview mirror...u will learn a lot....again, thats not to saw there arent jackass cops out there, there are, i have run into a few and they didnt like what i had to say to them, but most of us out here are just like you, we have kids (i also have a 4yr old who is the exact reason i bought my new mustang), house payments, etc etc etc and we are really just trying to do our job the best way we know how (plus there a quite a few of us who also are mustang fanatics )....if u ever wanna go for a ride along down in Olmsted county, lemme know, id be glad to take you or anyone else out....drive safe....

                            if anyone EVER has questions they want answered about law enforcment lemme kno, ive always tried to answer what i can...

                              I always wondered, when you see someone that looks like they're drunk... or say you see a fender bender but there's no cops around... do you call 911? It isn't exactly an 'emergency' but it's not like I really can just look up the local police stations number.
