My g/f over drafted her bank account oh like 6 years ago. Some where along the line of 400$ with wells fargo.
She knew and ignored it for a couple months because she was broke at the time had I of known I'd probably of just given it to her since it was for college tuition.
Wells Fargo sent it to collections, when she got the first collections call/letter what ever she doesnt really remember she paid the money. Yay problem solved?
Nope, she keeps getting calls from random collection agencies demanding payment for a wells fargo "formerly known as HSBC"?... Though I don't think the two were ever related, account.
Well, like I said she's just ignored it for the past couple years they call sure but she's in school until about 7pm most of the time. She's procrastinated this long over confronting it. She knows she doesnt owe the money.
Yesterday she got a call and this time, her Mom didn't recognise the phone number and she answered. They called asking for my G/F her mother was asking what about.
The collector told her mom, some debt of 500$ and some how or another it got around to the guy being a dick to her mom because her mom knows she doesnt owe this money and her mom was asking questions.
Anyhow, her mom some how managed to get the guy to email some contact info and the guy actually included, the amount owed, the account number ect on his supposed debt.
The company this time? Resolution Management LLC. AKA The Lien Center, AKA one Douglas J. Mackinnon reformed again. Or "the Law Office" or Jason Head LLC *sigh*
Literally, a thousand AKA's for this company this group and these scammers.
Here is how the scheme breaks down.
They this collection of people cache debts either legal or non legal. They then recruit a lawyer to secure their debt collection licenses.
They will then, have this supposed debt put on your credit report.. WELL THATS NIFTY?!!!
Yes, they can and will I know you're saying "well how can they get away with that!!! its illegal debt".
Well, its not binding debt. And so long as you dont prove you don't owe it anymore they will. And even if you do prove you dont owe it, you're still responsible for... Getting it removed from the credit bureau yourself. And IF or WHEN you do? Guess what?
That little cache they sell to eachother back and forth? The next company comes along and goes ahead and reports it.
Have they been busted? Yup, few have been put into country club jails sure. Have they been sued? Yup, when sued they file bankruptcy and the only asset left to claim is guess what? Illegal debt.
How do they keep doing this? They just sell debt to another company or cache it until the initial one goes out of business and wait for the next one to form up, then restart the collections again.
You're not required to pay anything you down owe, sure. But in the mean time these guys can still report it on your credit report.
Think you can sue them? Try getting a lawyer as my g/f found out today to sue. They want tens of thousands of dollars up front. None will work for a part of the settlement because they know just like I'm telling you now.
The only asset they have is non binding debt.
Oh and just in case you're thinking. "Well fuck its only 15$ I may as well pay it to get these guys off my back"...
Wrong.... Once they get busted, or one of the branches gets sued and files bankruptcy....
They just pull up that cache that debt and go at it again.
I used to be sympathetic to collectors, used to have to no empathy for anyone who didn't pay up their bills or complained about not owing money to the place that is collecting writing them off as liars.
Used to even think that, well... Fuck, you shouldn't of had something sent to collections if you didn't want these assholes after you.
Problem is, once they start they never stop and eventually. If you've ever had something sent to a collection agency even if its now settled you're going to get collected on again.
Do some reading about the folks, its a fucking catastrophe and I'm surprised something hasn't been done to tear down credit bureaus. I'm starting to even be sympathetic toward government owning the collection/lending industry.
