My kid lives with her mom, 25% of my after tax wages goes to dear ole mom.

My child is diabetic and has celiac disease, her HBA1C is above 14 constantly. Her mother, will allow her to live with me but refuses to give up the child support I pay. Something around 600$ a month + or -

She hasnt gone to school more than two or three days a week in the last 2 months, and the days she goes she's been late.

School Counselor says im screwed.

My child support case worker says im screwed.

Lawyer says its long odds.

What the living fuck am i supposed to do? I need some help.

Uh...if you get custody to the child, why exactly, would you be paying child support to an ex that doesn't have the child? Good luck though, this state is so anti-father's rights you can't believe it. I believe that this is actually one of the worst states to live in if you are a father separated from your child. Its an uphill battle all the way.

As bad as this will sound, you have to get her to the point where she can't take the stress any more and is willing to sign the papers for you to have custody of the child (after which child support is no picnic but you'll have the ground work down).

If the child lives with you but the mother does not officially agree to you having custody, she can screw you as much as she wants and get the best of both worlds.

I went through this with my folks. If your kid is over 13 or 14 they can make the decision what parent to live with. I grew up living with my mother and spent odd weekends with my father. I decided they lived close enough that I wanted to live with Dad.

Mom thoguth she would need to pay him child support to wich my father said she didnt and she was miraculously ok with it. She can't accept child support if she isnt supporting the child i.e. living with you. If you come to an accord that she doesnt need to pay you and you go to court it should be ok.

It was rough though, I had to write a letter at 13 or 14 to the judge telling him why I wanted to live with my dad. Kinda BS for a young teenager to go through. But i'd say you have a valid case.

No one has to lose custody though, it's still joint just the arrangements change.

If the kid lives with you, make the mom pay child support. It's 2-way street, at least it should be.

It sucks trying to change custody! been there still keep trying. IF you can prove that for the sake of the CHILDS well being she would be better off with you that's really the only way you have a chance. I'd say start talking to doctors and see if there are things that aren't being done by her mother that can be to make things better. The courts and the county don't give a damn unless the child is in a bad situation and it takes a lot to prove that! It's a huge uphill battle, but if you can prove it's in your daughter's best interest you may have a slight chance.

either way the mom sounds like a total piece of shit. whether or not she keeps child support should never be a deciding factor in who the kid goes with, it should be about what's best for the kid, not the white trash mom. she's just trying to take advantage of the situation and use her kid to scam money from the system, because she wouldn't even have the kid!
