    i need help

    hmmmm, just wondering the "legalities" of recording a phone conversation with someone with out them knowing.

    id like true answers, it would un-fuck my life, and possibly the stang.

    Only one party needs to know that the phone call is being recorded.

        Taping constitutes þinterception' of call, court finds 01/11/99 NEVADA--In early December, a divided state Supreme Court in Carson City held that Nevada's wiretapping statute requires that an individual obtain the consent of all parties before taping a telephone conversation. The controversy in the 3-2 ruling turned on whether individuals who tape their own telephone calls are "intercepting" those calls.


        Minn. Stat. § 626A.02: It is legal for a person to record a wire, oral or electronic communication if that person is a party to the communication, or if one of the parties has consented to the recording — so long as no criminal or tortious intent accompanies the recording. Unlawful recordings, or disclosure of their contents if there is knowledge or reason to know of the illegal acquisition, carry maximum penalties of imprisonment for five years and fines of $20,000. In addition, civil liability for violations statutorily can include three times the amount of actual damages or statutory damages of up to $10,000, as well as punitive damages, litigation costs and attorney fees. Minn. Stat. § 626A.13.

              I am sure that is all true but can that conversation be used in any legal setting? I dont know the rules but that seems too easy.

                    Record it. If it is determined later that, for some reason, you can't use it, then you are NO WORSE for having recorded it. Even if inadmissible in court, it can have a great psychological impact on the other party that they know you have them recorded. You can claim you have every right (you do) to record it and that you now have patent PROOF of your claims. The ball is then in YOUR court. They are the ones wriggling and worrying. Record it!!!!! If you don't, and you COULD have, you will kill yourself. Collect as much evidence as possible. Let the courts determine later what can be used!
