Remember the incident where the wacko pulled the gun on me while driving? Original Post I had put this nightmare behind me and moved on with my life, guess I can't move on just yet. At the pre-trial in November the prosecutor and defense had worked out a plea deal that both parties were satisfied with, the scumbag would plead guilty to a gross midemeanor and serve a few months in jail. Sentencing was to be on Jan 4th but I was out of town so I did not attend; however, I talked to the prosecutor and was informed that I had nothing to worry about and that if things changed I would be informed.
True to his word I have been informed that things changed, the defendant did an abrupt 180 and plead NOT GUILTY at the sentencing hearing. The thing that pisses me off is that I was just informed of this on Saturday via the supboena (3 months after the date of sentencing when he plead not guilty). The other thing that irks me is that the trial starts this Wednesday! If I had been out of town on vacation I would have been in contempt of court
WTF?! How about letting me know a few weeks ago or say back on Jan. 4th when they knew it would be going to trial!
On the bright side since he was stupid enough to turn down the plea deal he now faces the original felony charge (max 5 years). Hmmm..... 5 years versus a few months......gross misdemeanor versus felony......I don't see his reasoning but then again I could never figure out why he would pull a gun in the first place.
Oh yeah, I get $20 per day plus mileage and meal reimbursement.
This will be my first (and hopefully last time) testifying in court. Any advice? How should I dress? Thanks!
