    GF DWI Update - For Those Who Care

    Went to her hearing yesterday, for those of you that care and remember the thread i ran a few weeks ago...freaking girl got soo lucky!

    1 yr probation (20 days in workhouse if she violates it)
    $100 Fine
    90 Days license revoked
    1 Chemical Eval **Free**
    2 Classes $25 and $75

    They ended up dropping the 2 dwi charges and left the careless driving, and also kept the applied concent charge....

    Just to let you know Insurance gets affected more with a careless driving on the record then a DWI. This is because most DWI's get moved down to a Careless driving.

    This was just info for ya. Glad she does not have to pay too much. She will need to pay a reinstatement fee of $680 plus the cost of a new license which is $18.50. Plus a written DWI test.

            thats some pretty good news. carelesses still suck. mine just dropped off this past december after being on probation for three years!

              I wouldn't assume that in all insurance cases. My old insurance company USAA charges 2-points for Careless driving (standard moving violation is 1-point. ie.speeding). For a DWI/DUI, USAA charges 4-points.

              So one DWI is like getting 4 speeding tickets in one shot with their system. I researched all this once when I got a careless driving for jumping my 85' Toyota 4x4 near campus at St.Cloud State back in 97' . Cop turned around the bend as I was mid-flight I was BUSTED!!

                Im pretty sure a speeding ticket is 2 points and a careless driving is 4 points, Ive yet to get a DUI/DWI so I dont know about those though.

                  That could be. I just remember that careless was like getting 2 speeding tickets in one shot, and DUI/DWI was like getting 2 careless drivings in one shot. I hope to never get a DUI/DWI. I really shouldn't have to worry as I try not to drink and operate speedy equipment

                    The "Implied Consent" charge is nothing more than the license revocation.

                    What was her Alcohol Content? AC? Just curious.

                    Glad she got a sweet deal...kind of rare these days with DUI's.

                      Its not the Careless the insurance company looks at...although thats part of it...its the Revocation for an Alcohol Related Violation.

                      For arguments sake.... someone gets arrested for DUI. Goes to criminal court and wins....but neglects to fight the license revocation. Guess what.....no fines, no jail...no conviction....but the alcohol violation still goes on your record. Insurance still goes way up.

                      Doesn't happen that often as attorneys usually contest both the criminal and civil (Implied Consent).

                            .13's are usually Careless Driving's in the Twin Cities.

                            Here in Rice a .13 ....might...be a Careless. Thats about the cutoff.

                            Again glad she got the deal. Tell her not to change insurance companies or any type of coverage.....hopefully they won't run her record. Any changes and they usually do.

                              Thats good to hear. I know one of my friends got off lucky like that early last year, but that is another story all together.
