    Any guys ever have luck getting full custody of their kids?

    Looking for some insight and how bad of a fight it might be. I might be splitting up with my girl friend of 9 years and we have 2 kids together (6 and 7). I will be keeping the house and all the bill that come with it. I am unsure of any apt she might have or applications or anything. I do know if she moves out she prob will be going to a parents house and neither of them have the proper room for them. Let me know what you guys have gone thru if any of you have had the same deal or close. I live in Carver County so that isnt much help either.

    I know 2 guys that have full custody of their kids. So it's not out of the question. But being in MN, you obviously know it's going to be an uphill battle. And a steep one at that.

      It's extremely difficult and costly to get joint physical custody in MN if the mother fights it, even more for full. Your only saving grace is you have been there since day 1 in both of their lives, but the court will still favor mom unless you can prove she is a giant fuck up. Your best bet is to kill her with kindness and come up with a plan before you boot her and have it put in writing and entered into the court.

      You should plan on helping her find housing that is capable of providing space for your kids. The chances of you gaining full custody are not very good especially since you were not even married. If you think you will just be able to say you're breaking up with her and she moves in with mom or dad and leaves both the kids with you, you're dreaming man. There is no freaking way she is going to go that easily. Two kids is 30% of your gross pay in child support, think about that before you make a rash decision. I feel for you on this one, but have a very clear mind before you make your next move.

            It's easy to get joint custody in Hennepin county, being in Carver it'll be a crap shoot. The only way you'd have a shot at full (in any county) is if she's unfit, she has a documented history of being out of the children's lives, or there's domestic abuse. That's from my gf who is a family law attorney fwiw.

            Since you're not married any property will be dealt with in civil or conciliation court, family court will deal only with the custody of the kids.

            Do either of you have any skeletons in the closet that can be used against the other (ie. DWI's, assaults charges, drugs, etc...)?

                  I got some crap from years ago but I have letters from probation officers and judges that would help. She agreed to let me have pretty much full cost in the beggining due to she can not afford a place on her own and if she got a room mate she would have less room and prob a higher cost of rent. Iam not sure which way to move but I guess time will tell.

                    In some states they consider you married after 10 years together. Not sure if MN is like that though. You're at year 9.

                        Just from experience, since "no one" has custody as of yet, you may have a "shot", not a great one. But once custody is established, you have to prove that the child/ children are in some kind of harms way.

                          Ya its not easy my brother has been trying to do it for years. At first his ex wife did not want to see the kids for years she only had them every other weekend custody she willingly signed that. They had proof that the days she was to take them she was canceling and just going out drinking raves ect. Have also had friends that have came forward that knew both of them that said she was living in a house with a bunch of guys and drug use was happening. Note that both of the kids are girls coming of age so a house with alot of guys was very inappropriate. One point he had her admit to drug use and was gonna have her sign over fully custody because she just wanted to party and not take the kids but at last min she refused. Cant remember what it was with the drug test and why he couldnt get her to go. But ya as of recently she has not been wanting to sign over fully custody pretty sure mostly out of what it would look like for her, but the girls have came home past times with the older one saying she does not want to go over again as her mom was not nice to her and made her cry ect. Would think this should be enough to get fully custody but i guess not.

                            From what my lawyer told me....

                            This is no true. Technically since they weren't married the mother already has full custody. He will have to goto court to get any form of custody on paper.

                              If you are not in a common law mairrage state, your name on the birth certificate doesnt even grant you physical custody. i just filled out the paperwork to send out for my new baby girl. Basically you can get joint custody, but you will not be able to have them live with you since you were not married. its totally fucked up if you ask me. child support is 17% gross income for one child, and i believe 9% for every kid after, not to exceed 34% total. im not 100% on that i will have to look at the paperwork again. Basically you have to prove that she is a load, prove that she cant pass a drug test, or you'll be paying. Make sure you do everything you can to prove what you pay for and what you have paid for, so she cant go back at you for the first 7 years of child support even though she was your dependant. Sorry to hear about your luck. just take care of those kids please
