Getting hit by an uninsured person insurance questions.

So on my way to lunch today, some lady rear ended my car with a truck at a red light, pushed the trunk in, bent were the striker bolts too etc.

She told me she had no insurance and gave me the typical sob story that she would pay for it all out of pocket....I pretty much said screw that and called the cops and filed a police report.

I did file a claim with my insurance company ($500 deductible). Now the big question is how bad am I going to get hosed? Will or should I take her to court?

BTW this happened in Wisconsin (let the flaming dead deer stuff begin).

Yes they will but word to the wise. If you have any injury from the accident get a lawyer now and don't say another word to your insurance company as you could have already screwed yourself.

this is why you have uninsured/underinsured coverage on your policy, required by law. The insurance company will go after her for damages and if they aren't recovered your policy pays. It will likely take months to resolve, be patient. If you think your insurance company is out to fuck you then you should find a new company

This happened to me in November, my insurance company cut me a check minus me deductible and they go after the penis wrinkle that hit me. If they collect from the scrotum chin i'll get a check for 500 bucks (my deductible)

FYI. Last time I lived in wi you were not required to carry auto ins. Like you are in mn. That was over 10 year back, so it may have changed.

Yes in Wisconsin it is required, otherwise you get a $500 fine.

Hopefully I won't have to pay a deductible, maybe she'll finally get insurance. A mid 90's GM truck can't be that much money for liability unless you have a horrible driving record.

Well talked to the insurance rep today. She said getting the other party to pay up would be unlikely and i'll have to pay my deductible.

I might have to talk to you 2beer about switching over. You would probably be was easier to deal with.

Exactly. Once you have a judgement, you have ways of getting recourse. If they're excessively poor, it may take a very long time to recover funds though.
