Obama's other ace in the sleeve is to go back and say that the fine is not a fine but that it is a tax and it is constitutional under the general welfare clause. However, that will go against what he's been peddling to get this passed - that it's not a tax - and against his campaign promise of no new taxes on people making less than 250k/yr. Well since Obama appointed a couple justices, if the issue reaches them, they will surely fight on his behalf.

No way in hell Obama is going to let the law die though, they'll just go back and change things, like was already said. If people aren't required to buy it there is no way in hell it will work out, well it wouldn't work anyways, but the CBO's numbers will have to change.1998 Buick Lesabre Custom

None of this matters. There is already a circuit split, though I'm sure the opinion will be interesting to read when I get the chance.
The Supreme Court really will need to grant cert next term before the major portions of the law come into effect, otherwise it would be an even bigger mess than it already will be if the Court holds parts of the Act are unconstitutional. Most corporations have already structured their business plans on the assumption the entirety of the law will remain in effect (at least those that haven't been given a free pass by the Obama administration.)
I'm really thinking the fact the Fed's attorneys are arguing it is a tax when the legislative intent was clearly in the other direction will sway Kennedy to strike down the individual mandate.
All of you have to remember that the Court will most likely strike out the specific parts of the Act they hold are unconstitutional. Almost all of the Act will remain the way it is unless it is repealed, which is impossible until there is a massive power shift in the Senate or the Republicans gain the Presidency in 2012. By that time, most people will already have received the benefits of the Act and view it as a good thing rather than a detriment because the undesirable provisions do not take effect until after 2012. This thing was the product of impeccable strategy. Watch the polls...the number of people interested in a repeal of the bill are already shrinking.
