Not to jack the thread but I have a question about my case. Someone hit my vette while riding a pocket bike owned by the adult (April '09). They did not tell me until the next day only after I confronted them about it. We didnt notice the damage the night before but when we walked out to my car, we noticed a kid picking up pieces of a pocket bike in front of the car...found the damage the next day. I knew exactly were to go. Anyways the bike was owned by an adult and his sons friend hit the car. They claimed responsibility but I called the police to have a report done anyways. The guy admited to the cop that they had in fact hit the car but could not pay for the damage and would have to make payments to me. That was fine with me as I understood the guy was out of work and hard up for cash. Well after many attempts to collect the $$$ I went and got a copy of the report and the lady cop that took the report wrote H&R on it so there is no info on the report. Fast forward to November 2009, I call the police again to confront the guy. The guy once again admits to both of us that he hit it but by the end of the conversation denies it. The cop gets all the guys info gives it to me so I can file against him. The cop also says if I need him to go to court he would as the guy admited guilt to him as well.

Case?

Also, I had the car fixed soon after since I was going to sell it. Put the amount on a CC as the guy said he was going to make payments. CAN I CHARGE INTEREST since I had to pay interest on the card? Or is that my deal because I choose to pay on a CC?

God damn...what are you trying to say? Park your vette in your garage instead of on your lawn. That should solve most of your problems.

You are right. You posted the thread looking for input as to what to do/expect and it turned into a typical TCWangs pissing match. My bad for my part.

Here are some pointers for whatever they are worth and in no particular order:

• Be honest
• Be on time
• Be polite
• Be prepared
• Dress well (suit if you have it)
• Don't argue or interrupt the other person (part of the be polite part)
• Be respectful to the court.
• Speak clearly.
• Follow the direction of the court in how to answer and not interrupt.

When I say be prepared, I mean bring whatever documents you have and write down a bunch of notes ahead of time so you remember to cover everything. Bring any witnesses.

As conciliation court is fairly informal, you don't need a lawyer. I would also think the judge would not expect you to know the statute(s) that apply to your case. If you are going to cite statutes or case law, be sure you use the correct one(s). In your example above you quoted part of a statute from the adopted Uniform Commercial Code. Here is a list from the www that shows part of what the UCC covers:

As of 2008, the types of transactions included within the Code are:

• Sales (Amended Article 2);
• Leases (Amended Article 2A);
• Negotiable Instruments, previously known as Commercial Paper (Revised
  Article 3);
• Bank Deposits and Collections (Amended Article 4);

• Bulk Sales, previously known as Bulk Transfers (Revised Article 6);
• Documents of Title (Revised Article 7);
• Investment Securities (Revised Article 8); and
• Secured Transactions (Revised Article 9).

If indeed your case is covered somewhere under the UCC adopted by Minnesota and made into law, then be sure you understand how the list of statutes read (Scope and Definitions usually are found at the top) and be sure to read the entire section and don't leave anything out. I think you left out one or two parts in the statute you quoted that may have a bearing on the point you were trying to make.
