All the MFGs do it, to varying degrees. Whether you make a calendar with Ford, Chevy or Chrysler products, and you sell that calendar, you have to get it licensed. Images are NOT covered under first amendment rights, they are legally lumped in with T-Shirts and coffee mugs. Ford has been doing this for 15 years, and while this website guy may get indignant about it and vow to fight it, he is about to get a very expensive education.

As much as it sucks it is called copyright for a reason. Even if I release a copy right to some one for a image they still cannot make money on that nor can they let someone else. The maker still owns the rights period.

but if someone buys a car, isn't it theirs then? so how would it be copyright? ford no longer owns the car. or is it copyright of the ford logo and mustang etc?

You cant go out and sell there logo wo there permission. Just because someone buys a pic form me doesnt mean they can go make reprints. I still own the artist rights to the image.

If you take a picture of your car and distribute it free, there is no problem. If someone else takes a picture of you or your car and uses it for commercial gain without permission or licensing, there is a problem. Actually, Chrysler, Jeep and Harley were originally the worst at this.

Harley at one time tried to trademark their sound, if you can imagine that. This silliness is nothing new.

Autally your wrong, if some one copies my image and gives it to some one the that is illeagal and i assume the same goes for Ford. If they do something about something that small is another story.

IMO Ford pulling what they did does nothing but hurt them. There is no reason that something like this would affect them in nothing other than a positive way. I think it was stupid on there part.

I can take a picture of your car and hand it to people for free and I don't believe you have any legal recourse. There is no commercial gain and you were in the public domain. I cannot charge people for it or use the image in any promotional matter, such as to promote a car show. That's what I was talking about. That is for an image I took.

As for an image YOU took, yes, I would have rights to own the one image I paid you for, but could not distribute it in any way without your permission. You are correct about that, but that is not what I was saying above.

If Ford and others didn't enforce this, then a person could take a photo of a Ford logo and make a T-Shirt out of it. While I feel that they go to far, especially with businesses with the name Mustang in it, it is within their right

I think Cafepress pulled the MN F-body club merchandise way back when because there was a picture of an '02 Trans Am CE on the stuff.

I think the website Ford-diesel.com ran into some legal issues with Ford and had to change their website name to TheDieselStop.com . Ford said they could not use their name for the website.
